Посмотрел сейчас по ОКЕАН-ТВ документальный фильм о советских авианосцах.
Вспомнил,как по-детству,в 80-е годы частенько видел "Минск" и "Новороссийск" на рейде возле Тихоокеанска.Красиво,мощно!
Славное было время!
Ни одна собака не смела гавкнуть в нашу сторону.
А потом авианосцы продали,а подлодки у нас же на заводе на гвозди порезали,"утилизировали".
И вот результат-каждый пёс приблудный может покусать и убежать, радостно помахивая хвостом...

Этот блог вообще посвящен конкретному делу.
Я никогда не писал здесь ничего личного.Нет у меня потребности и резона делиться своими мыслями.
А сегодня захотел.
Сижу,слушаю Высоцкого.В общем это случается со мной часто.Лет 30-ть подобного опыта,не надоедает.
Мегачеловек.
Сказать,что Высоцкий лучший поэт России,не правильно.Это особое явление,не просто поэт.
Высоцкий-энциклопедия русской жизни.
В его песнях есть все,все эмоции,все ответы,даже на незаданные вопросы.И что-то еще.
Очень часто высказанная тобой мысль,как правило,бывает уже озвучена задолго до тебя.Я давненько не "умствую",не пытаюсь кому-то что-то доказать,объяснить.Кто обладает,тому не надо,а кто нет,тому  не к чему.
Владимир Семенович опровергает это.Никакой новой сверхинформации не сообщает,все известно,все понятно.И,тем не менее,слушаешь.Каждый раз что-то находишь для себя,либо по-новому на потолок посмотришь,либо покой обретешь.
Я как-то ru-politics предлагал изучать творчество Высоцкого в школе.Блоком,или отдельной дисциплиной.
Маленькие люди задумаются.Это ведь все-поэзия,история,социалогия,философия.Тройное дно.
ЛЮДЬМИ вырастут,кто сможет.
Причем нашими людьми,РУССКИМИ.
Они осознают весь масштаб,всю мощь и глубину русского менталитета.

Визит генконсула.

Генконсул приезжал.
Зачитал мне в очередной раз позицию госдепа-100 тысяч.Разовая материальная помощь.
Я детально обосновал ему неадекватность этой суммы причиненному ущербу и существующим реалиям.Предложил разумный компромисс.
Он доложит об этом в госдеп.
В общем,статус кво.Ровным счетом ничего не изменилось.
Что ж,будем работать дальше...

МИД

Максим Мищенко,депутат ГД,встречался сегодня  с заместителем министра иностранных дел РФ Рябковым С.А. По моему делу.
Рябков охарактеризовал это дело как очень сложное,но не безнадежное.
Замминистра выслушал наши предложения,пообещал помощь МИДа.
Если так,то в ближайшее время последует ряд серьезных шагов.

Сейчас посмотрел фильм по НТВ - "Джон Кью".
Сюжет такой.
У пацаненка лет десяти во время бейсбольного матча случился сердечный приступ. В госпитале сказали,что нужна пересадка сердца.Но у родителей нет денег и адекватной страховки.Пацан вот-вот отойдет и отец решил захватить госпиталь,чтоб добиться операции.Так и сделал.
В итоге нашелся донор,сердце успешно пересадили,мужику год тюрьмы.
Сенатор Хиллари Клинтон выступила с речью.
Хэппи энд.
А в оконцове надпись на экране - "FOR SASHA".

Не дали нам провести акции во время визита Хиллари.Побоялись барыню прогневить!
Вопросы они там "серьезные" решали,что может быть важнее защиты своего соотечественника?!

Поговорил сегодня с генконсулом Томом Армбрустером.Я ему звонил на прошлой неделе,узнать,что означает заявление посла Байерли,сделанное в блоге.
Генконсул осведомился в Вашингтоне и позвонил мне сообщить официальную позицию - Госдепартамент США не собирается платить мне компенсацию,сумму так называемой "материальной помощи" увеличивать не будут.Всё без изменений.
Я опять отказался от этой "материальной помощи".

1. Я очень рад, что американская сторона в лице Посла США в Российской Федерации после стольких лет молчания вступила со мной в диалог. При этом хотелось бы напомнить, что моей целью являются не диалоги, а получение справедливой компенсации за увечья, причиненные мне Дугласом Кентом.

2. Я считаю неправильным увязывать "большую политику" с той личной трагедией, которая произошла в моей жизни. Но тем не менее, хотелось бы напомнить американской стороне о некоторых фактах:

а) Государственный департамент США объективно должен действовать в русле, которое задает им их Президент - Барак Обама. А он в последнее время очень много говорит о том, что в американской внешней политике необходима "перезагрузка". Почему-то Госдеп не спешит выполнять поручения свеого начальника. Мне это кажется странным

б) На последних встречах, которые проходили между лидерами наших стран, Дмитрий Медведев пошел на ряд серьезных уступок американским партнерам по поводу сложных международных проблем (например по Ирану). Со стороны Америки было бы логичным ответить на эти уступки простым актом справедливости по отношению к мне


3. Хотелось бы еще раз обратить внимание чиновников Государственного Департамента на то, что выплата мне компенсации будет не "проявлением слабости", а наоборот продемонстрирует всему миру, что Америка может и готова изменяться. И российское общество и государственные чиновники (Лавров, Косачев, Маргелов) неоднократно говорили о том, что мы ждем от США акта доброй воли, который будет способствовать дальнейшей нормализации наших отношений.

4. В любом случае, ни я, ни мои друзья не прекратят борьбы до тех пор, пока Соединенные Штаты не выплатят мне достойную компенсацию.

В пятницу в 8 утра позвонил Макс - Маргелов приглашает в 12 часов к себе в Совет Федерации.
Съездил.
Не зря я давеча написал,что Маргелов мужик хороший.Он еще простой в обращении,не пафосный и крайне дельный.Времени у него было в обрез,поэтому он сразу изложил свое видение проблемы и предложил план действий.В подробности этого "плана захвата городу Парижу" вдаваться не буду.
Напоследок Михаил Витальевич подарил книгу про своего великого деда. 

Надо бы такую же акцию замутить - мощно!

О Деле Кашина

Я получил сотни вопросов и комментариев от вас, и, хотя  я не могу ответить  на все вопросы, я стараюсь их все прочитать и дать как можно больше ответов.

Я всегда рад вопросам на «трудные» темы – в этом вся суть блога – но я хотел бы избежать оскорблений и выкриков, это печально, когда блоги используются только для этого. Я бы хотел ответить на многочисленные комментарии, касающиеся дела  Александра Кашина, молодого человека, пострадавшего в дорожно-транспортном происшествии с участием американского дипломата во Владивостоке в 1998 году. Я глубоко сожалею, что господин Кашин пострадал в этом инциденте, это огромная трагедия.

А теперь перейдем к фактической стороне дела:  хотя суд и не признал вины дипломата в ДТП и Государственный департамент не несёт ответственности в соответствии с американским законодательством, госдепартамент готов предоставить господину Кашину материальную помощь для оплаты медицинских счетов. Я понимаю, что никакие деньги не смогут помочь Александру вновь обрести прежнее здоровье, но надеюсь, что, по крайней мере, это улучшит его жизнь. До сегодняшнего момента господин Кашин не принял эти деньги. Но предложение остается в силе, и мы надеемся, что он его рассмотрит.

Спасибо,что наконец-то ответили на многочисленные вопросы,заданные в Вашем блоге по теме "Кашин vs. Госдепартамент".
Я рад,что Госдепартамент выходит на диалог и готов обсуждать вопрос о справедливом урегулировании этого дела.Но если речь опять идет о том унизительном предложении,о сумме,не покрывающей расходов на пожизненное лечение и содержание (не говоря уже о моральной компенсации),то компромисса не получится.
Если Вы готовы серьезно обсудить этот вопрос и найти приемлимый,справедливый вариант решения,то я готов к разговору.

13 сентября в 12.00 у посольства США в Москве (Бол. Девятинский пер., д.8, м. Смоленская) 300 человек — активистов движения «Россия Молодая», провели акцию, посвященную несправедливому удалению послом США Джоном Байерли из собственного блога всех вопросов, касающихся судьбы Александра Кашина. Активисты напомнили американскому послу о судьбе российского гражданина, искалеченного американским дипломатом 10 лет назад. Одновременно акции прошли в других городах РФ: Екатеринбурге, Челябинске, Белгороде, Курске, Таганроге, Астрахани, Орле,Тамбове,Липецке.

Лидер движения «Россия Молодая» Максим Мищенко: «Мы уже давно помогаем инвалиду Александру Кашину, в том числе добиться справедливости от США. Действующий посол Джон Байерли, пообещавший ответить на все вопросы российских граждан в своем блоге, лишь красиво размышляет о демократии и справедливости, а вопросы о Кашине тут же удаляются, что засвидетельствовано в скриншотах. В ходе акции активисты движения продемонстрировали театрализованную постановку, героем которой стал бывший консул США во Владивостоке Дуглас Кент. С бутылкой виски в руке, преступая законы России, представленные в сценке красной лентой, Кент демонстрирует отношение Америки к гражданам нашей страны. Затем героя хватают активисты движения и сажают в клетку, тем самым обозначая собственную отрицательную позицию по отношению к преступникам, укрывающимся за дипломатическим статусом.

Dear President Obama:

 

I apply to you as to the highest instance and do hope that as President of the United States, you will be able to help me in my humiliating battle for my dignity and justice.

 

I am not sure you have ever been told about my story that has been unfolding on the territory stretching from Vladivostok, Russia to Washington, DC for 11 years now.

 

On October 27th, 1998 in the City of Vladivostok, Mr. Douglas Kent, Consul General of the United States in Vladivostok, was driving under the influence and caused an auto accident as a result of which I, at that time a 23-year old young man, suffered spine damage which left me disabled and wheelchair-bound for life.

 

The investigation has proven the guilt of Mr. Kent but his diplomatic immunity made it impossible to bring him to justice.

 

In 2000, I filed a civil suit in Philadelphia Court. The hearings stretched over the period of 6 years and were held in Philadelphia, PA; Alexandria, VA; San Diego, CA. When the case was referred to the Ninth U.S. Circuit Court of Appeals, the Judge delivered an outrageous judgment on August 10, 2006. The ruling states that Mr. Kent was acting within the scope of his employment when he caused an automobile accident while driving home from gym. The ruling bars me from suing in U.S. courts because federal employees are immune from liability for torts committed within the scope of their employment and the government is immune from suit for tort committed by its employees abroad. This ruling leaves me without recourse against the man who ruined my life. I have not received a single cent for the loss of my health and I am now left with no option for necessary treatment or a decent life.

 

In March of 2008, having given up on the opportunity to achieve justice and in protest to the treatment I had received from the United States government, I took the only action I felt was left within my power and began a hunger strike. It lasted for 20 days and resulted only in further health deterioration. During the hunger strike, the US Department of State offered me $100,000 in compensation – an amount which not only seemed ridiculous to me but also humiliated me immensely since it would not cover even two years of medical treatment for a quadriplegic in Russia. 

 

After that hunger strike, in the course of 2008-2009, 11 protest rallies were held in 4 cities in Russia (Vladivostok, Yekaterinburg, St. Petersburg, and Moscow) – those where there is a U.S. diplomatic mission. A committee in my support was established. This committee is the one that initiates such rallies.

 

On March 6th, 2009 in Geneva and on March 31st, 2009 in Hague, the Russian Minister of Foreign Affairs Mr. Lavrov discussed the case with the Secretary of State Hillary Clinton.

 

On June 3rd, the Chairman of the Committee on Foreign Affairs Mr. Margelov forwarded a letter to the Chairman of the Senate Committee on Foreign Affairs Mr. J. Kerry and to Senator Nelson. On June 29th, 2009 in Moscow, a joint meeting of the Committees on Foreign Affairs of the State Duma and the Congress was held where my case was presented. At the State Duma, I also met with Congressmen Berman and Rohrabacher who pledged their support.

 

Despite all the numerous protests, support from politicians, and constant media coverage the case does not get off the ground. The Department of State still sticks to its cynical and inhuman attitude and has no intention to grant me a fair compensation. I am left in absolute stagnation, wheelchair-bound for life.

 

When Georgian diplomat Geuorgui Makharadze drove under the influence of alcohol and struck and killed sixteen-year old Joviane Waltrick in Washington, D.C., the American government brought pressure to bear until justice was done and his immunity waived. The question still remains why the same has not been done for me, a Russian citizen.

 

In believe that this case is hurting the relations between our two countries and adversely affects the attitude of Russian citizens towards the USA. This case is no longer viewed in Russia as my “private matter” but rather as a spectacular example, a litmus test for the U.S. Department of States. A resolution in my matter would serve as a good signal for the "re-set" of Russian-American relations recently proposed by you, Mr. President.

 

Now is the time for the U.S. to demonstrate the depth of its compassion and commitment to justice, not only because it is the right thing to do but also because your intervention in righting the wrongs of Mr. Kent will help the United States in its effort to continue building strong and healthy relationship with Russia.

 

I put my faith in you, Mr. President. I do want to believe there is light for me at the end of this deep 11-year long tunnel of despair and hope.

Камень с поверхности Луны, на протяжении 40 лет находившийся в экспозиции Национального музея Амстердама (Рейксмюсеум), оказался куском окаменевшего дерева вполне земного происхождения

Рейксмюсеум приобрел экспонат после смерти бывшего премьер-министра Нидерландов Виллема Дрееса. Экс-премьеру камень в 1969 году подарил посол США во время визита в Голландию побывавших на Луне астронавтов.

Образец лунного грунта считался одним из самых экзотических предметов коллекции Рейксмюсеума и был застрахован на сумму в 100 тысяч гульденов.

Однако в 2006 году эксперт, увидевший камень, выразил сомнение, что НАСА рассталась с уникальным образцом менее чем через три месяца после окончания лунной экспедиции.

Приглашенные музеем геологи уже после беглого осмотра заявили, что камень не имеет никакого отношения к спутнику Земли.

В четверг после проведения экспертизы они уточнили, что "лунный камень" является куском окаменевшего дерева, чья стоимость не превышает 50 евро.

Представители музея заявили, что несмотря на "разоблачения" они сохранят экспонат в экспозиции как памятный курьез.

The History of my Fighting.Part 1

Not every day I ended up in intensive care. For the first time it happened on October 27, 1998. It was an ordinary fall evening. I flagged down a cab on Okeanskiy avenue near Dalrybvtuz (the college I was attending), took a seat in the back, which is not typical for me since I normally take the front seat, but there was a girl sitting next to the driver in the front. The cab took off and in a couple of hundred meters it got to the point where my life (the real normal life) had ended up and this whole tragic story started to unfold.

An extract from a criminal case:

On 10.27.1998 at around 9:45 p.m. a motor vehicle, Chevy Blazer, license plate # 004D 001 25/RUS, operated by US citizen Douglas Barry Kent was drivingalong Semyonovskaya street in the direction from Uborevich street toward Aleutskaya street of the city of Vladivostok. Near building # 13 on Okeanskiy prospect when the driver of the Chevy Blazer was approaching to the intersection of Semyonovskaya street and Okeanskiy prospect, he failed to comply with paragraph 1.1, 1.3, 13.9 and 13.3 of the Traffic Rules Code and the traffic sign 2.4 of the Traffic Rules Code failing to yield to Toyota Camry, license plate # A 451 BX, operated by A.A. Bulashev, which was moving along Okeanskiy Prospect (Okeanskiy Prospect is considered main road in relation to Semyonovskaya Street) and crashed into it. As a result of this collision the Toyota Camry was pushed away on the oncoming traffic lane, where it collided with Toyota Land Cruiser, driver I.V. Volodin, license plate # E 383 AУ, which was moving along Okeanskiy prospect toward Svetlanskaya Street. As a result of the accident 23-years old A.N. Kashin, who was a passenger in the Toyota Camry, got bodily injuries, which according to the forensic medical investigation #5172 of 12.21.1998, greatly undermined his health, and according to the medical and social expert commission of the Ministry of Social Services of Russian Federation of 12.18.1998 A.N. Kashin received disability group I with 100% total incapacity. Based on this fact on 11.05.1998 Directorate of Internal Affairs of Vladivostok initiated a criminal case in accordance with article 264, part 1 of the Criminal Code of the Russian Federation. The investigation reviled that the car accident happened due to the fault of Douglas Barry Kent.

In other words, the cab was moving along the main road and approaching the intersection we were hit from the right a huge SUV Chevy Blazer, which was “flying” down the hill on a minor road. The SUV crashed right into the door I was sitting behind. This is how everything began, or should I say ended? Fortunately nobody else besides me was hurt in the accident.

Afterwards from my conversations with witnesses I found out how the things were unfolding at the accident site. The driver of the SUV Chevy Blazer, U.S. Consul General in Vladivostok Douglas Barry Kent, didn’t even care to ask about the condition of the passengers of the crashed, smashed into pieces Toyota Camry, didn’t try to administer first aid. He locked himself inside his vehicle waiting for traffic police officers and the consulate officials to arrive. The traffic police officers who arrived to the scene of the accident recognize that the Consul General Douglas Kent was under influence, as they could smell alcohol in his breath. However, he refused to take a breathalyzer test. Kent’s behavior was relaxed, he kept smiling. Meanwhile I was being carried to the emergency ambulance car.  This was the end of my short encounter with Consular General in Vladivostok Douglas Kent. Unconscious, I was taken to the intensive care, and Kent headed to Nautilus night club to resume partying after an interruption. At the night club he was really trying hard to recover from the stress. According to one of the club’s employees, he fought the stress to the point that he started taking one striper’s panties off her with his teeth.

On the way to the hospital my consciousness was on and off. The doctors were afraid to lose me and were constantly talking to me asking my name, addresses and phone numbers of my relatives they could contact to inform about the accident.

The first time I realized that I could not move was at the hospital. I could not feel anything, not even pain.  The doctors had a look at me, performed a tomography. The verdict was not comforting: closed complicated transverse comminuted fracture of the body at the 6th and 7th cervical spine vertebras, damage of the spinal cord, subarachnoid bleeding, concussion of the brain, scratches on the face, and hematoma of the head.

The surgery was scheduled.

The surgery went on for several hours. The vertebras were shattered, their fragments penetrated the spinal cord in places, and weren’t that easy to be retrieved.

After the surgery, the long recovery period has begun.  I was almost constantly given an IV, as well as antibiotics, since my body was extremely weakened and non-viable on its own.  I turned into a plant, being fed through tubes with a nourishing liquid. To fall asleep I needed to get pain killers and sleeping aid pills. After a couple of days of immobility, my body started to develop bedsores and since no special bed or a mattress was available, I had to be manually turned every three hours. My mother physically did that, and she was always there by my side then, and for the following months and years.  Unable to eat, I lost tens of kilograms during my stay at the hospital and was brought home as an immobile skeleton covered with skin in bedsores.

Not once did Douglas Kent show up at the hospital. From the first day of the accident the hospital was filled with reporters.  Every Russian channel was covering the event. I met general counselor D. Kent three months later, at a rehabilitation center. The only thing he was concerned with was the news coverage of what happened. He kept telling me what a good person he was and asked me not to speak ill of him to the reporters. And not a single word on any help in my situation.

Thanks to the doctors and my natural vitality I somehow miraculously made thru to the New Year’s Eve.  That was the first year of my personal nightmare. I was released from the hospital a couple weeks later. At the time, both of my legs were fully paralyzed, arms were partially paralyzed, I was unable to open my fists and I was desensitized from the shoulders down. I was lying down motionless, being unable to even lift my head up by myself to say nothing about turning on another side. This was the condition when I arrived to a rehabilitation center, where I spent two months, and got back home without much improvement. Five months after the accident I was back home. A young healthy man had left his house one day and came back an immobile, half-alive plant.

The few first months at home were difficult, since there were no signs of progress. My mother quit her job to take care of me full time, since we had no money for a sitter. My father built a special bed with side bars and stands, with foam-covered rope hanging in between. Using my arms (not hands, which were still clutched into fists) to grab the side bars and the rope I was able to lift myself up to turn on my own (the foam on the rope was necessary to protect the skin on my arms, which had become very sensitive and could be  easily damaged even by one careless move). I lied on bags filled with hay, since there was no special anti-bedsore mattress available, even though I asked Kent for it.

Slowly things started moving forward and I started to come back to my senses and recuperate. At that time it was possible to drastically improve my health, increase the body functions, and rehabilitate my arms, maybe even legs. I have been told that many times by various rehabilitation specialists and, realizing that myself, I trained practically 24/7.

I taught myself to open my fists, and now, on the contrary, I am unable to close them. My parents made a sack, filled it with sand, creating a weight lifting piece adjustable from three to five kilograms in weight. I used to lift it up while lying on my back. I was also given a couple of one kilogram dumbbells with handles to train my hands. Soon my arms were rehabilitated. However, I am still unable to use my hands, like holding a pen, for example, only to press on buttons.

That was the perfect time to go to a rehabilitation center and get professional help under the supervision of doctors, using the latest developments in the area. But I did not have any money of my own, neither had I received any compensation from the causer of my sufferings who had by that time left Russia without paying  me a penny for my damaged life and without taking any responsibility of paying my medical bills. He crushed me like a dog with his heavy weight jeep, and left to die in a trench. Kent was absolutely sure of his impunity, hiding behind the diplomatic immunity.

At that point, on top of my health problems and the fight for my life, I also had to battle Douglas Kent supported by the US Department of State for my rights and the compensation that would allow me to get the medical treatment I needed.

As I had mentioned earlier, there was a criminal case opened in regard to the occurred car accident. The investigation proved that the driver of the Chevrolet, Douglas Barry Kent, was the one at fault. And while he was not denying his guilt, he was refused to accept any responsibility for the incident.  The diplomatic immunity from criminal prosecution gave him the feeling of being a “white master” at the times of colonial invasions, who was able to kill and torture the “natives” without reprimand. And it does not come as a surprise when you know that the general counselor of the United States in Vladivostok, Douglas Kent, was a member of a Nazi organization in his youth.

It is possible that during that time he was recruited by one of the secret services. That would be the only explanation as to why the Department of State profusely refused to not only to give up Kent to the Russian or American justice, but even to give out his whereabouts, upon the request of the Russian court and Russian road police in order to service him with a notice to appear in court. But I have gone too far ahead in the story; I will try taking one step at a time. 

During the course of the investigation numerous requests were issued by the Russian road police to the Embassy of the United States to take away Kent’s diplomatic immunity, but all failed. There are examples of other countries being cooperative in similar situations, like the one involving the Georgian diplomat G. Maharadze. In 1997 in the United States there was a tragic incident involving a worker of the Georgian Embassy George Maharadze. He caused death of a 16 year old American girl in a car accident. Under the pressure of the United States government, the president of Georgia Eduard Shyvarnadze had taken the diplomatic immunity from Maharadze, making his arrest and the following investigation possible. As the result, in December of 1997 Maharadze was found guilty of unintended murder and sentenced to seven years of prison. He was released from the federal prison in New-York in June of 2000 to serve the rest of his sentence in Georgia.  So the question remains, why did the United States government that insisted on removing immunity in Maharadze’s situation not return the favor while being asked to take the diplomatic immunity from Kent?

It is obvious that the Unites States is very strict about protecting the rights of its citizens, whereas I am considered to be a second-grade person, not worthy of justice. This is a perfect example of double standards. Here is another example: the case of a Russian diplomat in Canada, A.Kniazev. On 27th of January 2001 A Russian diplomat in Canada A.Kniazev caused an accident, involving a female casualty. Kniazev was deported to Russia, put on trial and sentences to four years in prison.

It is clear that all countries except the United States keep to the ethical-moral standards, according to which the justice has to be done, despite all immunities.

The investigation was closed, but instead of it going to trial, the case was closed due to the impossibility of bringing the individual with diplomatic immunity to criminal justice.  And Kent was long gone from Russia anyways.

When I was in the hospital I was approached by different lawyers who offered help with recovering money for medical treatment from Kent. There were lots of them, young and old, experienced and not so much, with different intentions. Some of them wanted to work for the percentage from the awarded compensation; others were looking for free PR and celebrity status, as this case was widely publicized on TV and in press. They all were out of sight almost just as fast as they were popped up. It seemed like somebody was strongly encouraging them not to get involved in this case. Eventually with the help of my friends I found a good lawyer, who didn’t need cheap fame. His name was Konstantin Mikhailovich Sinyakov. He put together and filed on my behalf a civil claim for indemnification against Douglas Barry Kent in Leninsky court of Vladivostok. However, the court never started to try the case since the defendant failed to appear for the hearing. The president judge N.V. Kuchinskiy scheduled court sessions multiple times, nevertheless defendant D. Kent never showed up. As I mentioned earlier, the officials were not able to serve him a request for summons/notice to appear. The US Department of State went into highly defensive mode and rejected all requests of the Ministry of Foreign Affairs to disclose Kent’s whereabouts.

Meanwhile I was staying at home in Bolshoi Kamen. Gradually coming to consciousness, I was increasing the intensity of my training. My gym equipment was represented by the bed, two weights, and a sack of sand. By summer 1999 I was already able to sit in a wheelchair for half an hour. If I tried to do it longer I felt really tired, dizzy, my blood pressure was going up and down and I was submerging into semi-subconscious state. However, shortly I passed this stage and I could get from the bed into the wheelchair without an outside help. I devoted all the time for the training but the sleep and meals. By the way I started to hold cutlery in my left hand, since it was functioning a little better than the right one. So I was born right-handed turned into a lefty. My body wasn’t regaining sensitivity; instead I started to feel pain in the parts of my body that could still feel – my neck and insides of the arms. Everything hurt, the skin, muscles, bones. Especially bad was the dull pain in my right shoulder, which took the impact from colliding with the SUV. In a word, it was like in one famous anecdote – I want my enemy to have just one tooth left, and suffer from toothache.

Insensibility is terrible as it is, one cannot possibly get used to it, and there are some real dangers associated with it as well. One time my leg slipped off the wheelchair. I didn’t feel it and went on moving. The leg twisted and broke in the foot. It swelled a little more than usual, but ever since I became paralyzed my legs swell all the time. Due to the immobility I started having problems with my kidneys. I found out I had a fracture only two weeks later. I couldn’t diagnose it myself without an x-ray and it was a huge deal to get to the hospital. During 1999-2000 I almost never left my apartment. So you always have to be extremely alert.

Another accident. I was in the shower and all of a sudden cold water was shut off. I didn’t feel it and didn’t turn hot water off. As a result I burnt skin on my leg and it took months to heel. My body in general has changed, any damage, even a tiny scratch takes a long to heel.

Ok, I’ll quit boring you with my health problems and will go back to legal issues. That is what my life is now – health problems and courts.

As you can see the civil suit just like the legal suit hung in the air. Time was passing by along with the hope to receive so needed treatment and rehabilitation. Even a thought of it was very painful, because a possibility of resuming to normal life was so real if I didn’t miss the right moment. But I still had no money and stayed in my room, training my body on my own. Neither the State Department nor Kent tried to contact me. It seemed like the Russian authorities forgot about me as well. Then I began to contact various political parties and in summer 1999 my cry for help was answered by Evgeniy Bolshakov, a State Duma deputy, member of the Liberal Democratic Party of Russia. He sent a couple of deputy inquiries to the Ministry of Foreign Affairs and to the General Prosecutor’s office. But nothing changed, the government couldn’t or didn’t want to make the US to fulfill its obligations before me. My own country had no intention of treating my injury at a good hospital, and cover such a treatment. Bolshakov did not limit his help to assistance with the legal matters; he also covered the expenses for my stay at one of Vladivostok’s hospitals, where I underwent a therapeutic examination and where they checked on the condition of my inner organs. The examination revealed that I had calculus in my kidneys and bladder. A year of immobility was taking its toll on my health.

After that two more deputies took part in my destiny. Sergei Zharinov, a local Duma deputy, and Ivan Rogovoi, a Duma deputy from Primorsky krai, the district where I actually reside. They too sent their written requests to various Russian agencies. However no results followed. Court proceedings never started. Defendant Douglas Kent was nowhere to be found. The US Department of State wouldn’t disclose his whereabouts. That was the beginning of the year of 2000.

Having lost faith in the Russian justice system I began to consider a possibility of filing a lawsuit against Douglas Kent and his employer, the US Department of State, in a US court. One day I was listening to a radio live show that featured the chairman of the bar association of Primorsky krai. I called him and asked if being a Russian citizen I could file a lawsuit against an American citizen in an American court. He said that theoretically speaking I could, but in reality it would be almost impossible as it would cost a fortune, legal representation expenses, other administration fees, etc. But he was wrong. I started calling all my relatives and friends. And that’s how I found the law office of John Gallagher in Philadelphia. When I contacted him he already knew about my case, since there a lot of Russians working in his office. This made it easier for me to explain the situation. I spoke with John a couple of times over the phone before he agreed to work on my case. John also defrayed all expenses for the case. He simply had no idea what this all will turn out to become. The whole process has been going on for 8 years.

In the fall of 2000 I withdrew my lawsuit against Kent from Leninsky court of Vladivostok, which by the way didn’t hold a single hearing in my case, and in October on my behalf John Gallagher filed a lawsuit against Douglas Kent and the US Department of State in a Philadelphia court.

After John Gallagher had started to represent my interests the pace of the work picked up. In February of 2001 I met him for the first time in Moscow. Prior to that we only conversed over the phone. Besides John I also met with US congressmen Curt Weldon and Hoyer there in Moscow. They came to Moscow for discussions of antimissile defense issues. John knew Weldon personally and he was able to organize our meeting at Hotel National, where the American delegation was staying. Even though the hotel is one of the best hotels in Moscow it wasn’t handicapped accessible, so a couple of people had to carry me inside. The congressmen listened to me with interest, expressed their indignation with Kent’s behavior and with the reaction of the US Department of State, and promised to help me. My trip to Moscow, 9 hour flights were taking their toll on me. I fell seriously sick as soon as got back home. It was caused by the calculus in my bladder, which apparently were disturbed due to all the moving around on the trip. I decided to go for surgery, but none of the hospitals in Vladivostok was willing to admit me. Finally I was admitted to the railroad hospital. John covered the expenses for the surgery and a separate post-surgery hospital stay. The surgery was a success, the doctors extracted a huge calculus, 4 cm in diameter. After that I started to feel much better. In May of 2001 I took a flight to Moscow again. This time John organized my meeting with rehabilitation specialist Robert Voogt, Ph. D. from the US. He was supposed to be our expert in the court. Doctor Voogt examined me, studied the situation with rehabilitation opportunities in Russia and put together a detailed report, in which lined up all the requisites for my life and medical treatment as well as indicated the prices. The calculations totaled to $201,500.00 required annually. The report concludes that provided that I live until 75 years of age the overall required amount would be $10,236,000. The doctor stressed out that this is money is only to cover the required treatment, and does not include any compensation for the moral sufferings I was subjected to. Now my claims to Kent and the US Department of State were not only reasoned but supported by proper documentation.

Under the US laws when a person files a civil claim to the court, the plaintiff him- or herself is to inform the defendant about the forthcoming court hearing. We could not serve Kent for a year and a half, from October 2000 until ---------- 2002. Kent’s whereabouts were kept secret. The US Department of State refused to disclose the information. The quest to find the uncatchable criminal has began. John Gallagher hired a detective and put an ad in the Washington Post and in the International Herald Tribune looking for Kent. In ------ 2002 in a Laundromat in Arlington locals identified Kent based on his published photo. Now he could not avoid being served with the Notice to Appear before the Judge. The court hearing was scheduled for -------- 2002 in one of the courts of Alexandria, VA, where Kent was residing at that time. In order to prepare properly for the upcoming trial Mr. Gallagher came to Vladivostok in July of 2002. Here in Vladivostok he made another investigation, interviewed all the witnesses, everybody who was involved in the investigation (road police officers, prosecutor’s office officials). We had just one more thing to do – to get myself me to the US for the court hearing. That’s where the problems started. The Consulate General denied me a US visa. They really didn’t want this trail to take place and were doing everything in their power to get in my way. Nevertheless my third attempt resulted in a visa.

I was flying to New York thru Moscow, spending the night in Moscow. The plane from Vladivostok landed at night and my connecting flight to New York was not until the next morning. I spent the night at a hotel near the Sheremetievo airport.  I took a taxi to the hotel, but was unable to move from the taxi to the wheelchair by myself. The taxi driver was not strong enough, and the only one who was willing to help me turned out to be an American. There you have it. 140 million Russians around me, but the only one to help was an American.

I received a wary greeting from the United States. I was held at the JF Kennedy airport customs for about 40 minutes. I thought they were going to send me back to Moscow. But somehow I got though. I was met by a family friend, Daniel , who helped me find John Gallagher some time back. He immigrated to the United States about 30 years ago. I stayed in Philadelphia, at the house of his father, Yakov Matvejevish.  My everyday needs were met very well by Daniel. I was also assisted by Misha and Raya, who were immigrants from the USSR as well.

A couple of days upon my arrival we were scheduled to appear at the court of Alexandria, Virginia, which is a satellite city of Washington DC. Daniel, Misha, Larisa Tenberg and me, all took a car to DC. John Gallagher and Michael Ferarro, who was a lawyer invited by John to participate in the process, were travelling by train. Michael was a very interesting person, having been a colonel fighting in Vietnam, before becoming a lawyer. At the hotel, I had a meeting with reporters from the “Washington Post” and the “National Public Radio”. There was a reception at the hotel that night, with numerous politicians present, including Court Weldon. When I made his acquaintance, he convinced me of his support and as it turned out later, he meant what he said. In of May 2004 at a congress hearing regarding the issues of human rights in Russia, where president Putin was present, Court Weldon brought up my case. Later, in an interview he stated he would not give up until he receives a definitive answer from the Department of State regarding the case of Alexander Kashin, who simply wants to get his health back.

We went to court in the morning. This was the first trial in my life. Before that day I had never even been inside a courthouse. The proceeding was very technical, since had to go over the generalities like whether Kent can be prosecuted and if the lawsuit should be accepted for processing. At the hearing Kent’s attorneys claimed Kent was residing in San-Diego, California, and the judge changed the venue to San-Diego. That was the end of the trial in Alexandria.

I visited Washington DC twice after that occasion. Once, I came to Fox News, to be in a special news report, which would coincide with President Putin’s visit. They held hops that he would bring up the question of injustice that was being done to me by the United States government during his meeting with President Bush. But our hopes hit the dust. It is not surprising of course, why would such “powerful masters” bother themselves over such a minor issue as a person’s life?

Last time I went to DC to meet Congressman James Lengvin. He was also wheelchair bound, like myself. He saw a news report about my struggle on TV and invited me over. After our conversation he wrote a letter to the Secretary of State Colin Powell.  No response followed.

 In December 2002, when I was already in the United States, John Gallagher wanted to arrange a press conference in Moscow with the participation of American congressmen and the deputies of the State Duma of the Russian Federation.  We decided on the time and location, faxed out invitations to MSM. I personally called every agency and reporter that had written about me. Everyone promised to attend. But…not a single person showed up. In the courtroom there sat attorney John Gallagher, myself, delegates, and congressmen, but not even a single reporter. It seemed like there was someone at the door making all the reporters turn around and go away.

Except my trips to Washington DC, I also had some business in Philadelphia. I met with doctor Wooght once again. He wanted to examine me for changes in my condition once again, evaluate the dynamics, but did not see any improvements since we met in Moscow a year and a half earlier. I was also examined by Doctor Staas, the director of the rehabilitation center. He said there still was a very good chance of improving my health, but we had to start the rehabilitation procedures in the center immediately. That was no news to me. The mystery still remained, however, where to get the $200,000.0 thousand dollars, the price for a single rehabilitation course. And I would need to keep taking these courses non-stop for the rest of my life. And the mystery was to be solved by the United States Department of State.

I spent eight months in the United States. I accomplished a lot, but still failed to get any compensation from the Department of State for the broken neck and the destroyed life. I still did not get to the real therapy. The time was slipping away and I was still bound to the wheel chair.

I returned home in July 2003. The next three years were passed in the painful anticipation of the decision of the United States court. The time was passing by, but there was no progress. I spent all of my days exercising. I could not sit still for longer than half an hour without my muscles starting to spasm uncontrollably, which gave a very unpleasant feeling. I entertained myself with books, television, and, of course, the computer. But through all that, of course, I was waiting for a call from the United States.

And then one day it happened. On the 10th of August 2006 the San Francisco court of Appeals granted Kent’s appeal and declared him free from criminal prosecution, giving him green light to do anything he wanted without any punishment. In his speech the judge especially thanked Kent for driving the car himself without using a driver and thus saving American tax money. This was a case of rare cynicism.

With this ruling the court took away from me any right to legally fight for the rightfully owed compensation for the stolen health. At that point all the legal arguments were exhausted. I could only count on the non-legal levers, such as the Russian pressure on the US government. But those hopes were very slim, since for the last eight years they had done nothing.

On the 28th of August 2006 another opportunity presented itself. The United States Ambassador in Russia, William Burnes, visited Vladivostok. While he was at a meeting with students, a social youth organization “Our County” rallied outside, blocking the exit and demanding that the Ambassador would meet with me. Since I was there and we did have a meeting. I passed on the documents to the Ambassador with my demands to the US Department of State. The Ambassador promised to deliver these to DC and help me out. I waited for two more months and on the 27th of October 2006, on the anniversary of the accident “Our Country” was arranged a rally outside the Consulate of the United States in Vladivostok. A few hours prior to that, I received a call from the Consulate informing me that the Ambassador had passed on the documents to DC; I guess someone had been swimming across the ocean with them for two months.

In the meantime, certain totalitarian regime practices where put to use in Philadelphia as FBI searched the office of attorney John Gallagher. The only documents that caught their attention were my files. They confiscated them for investigation.

And that was it.

Получил письмо из МИД.Министр С.В.Лавров оказывается не только 6 марта в Женеве говорил с госсекретарем Х.Клинтон обо мне,но и 31 марта в Гааге поднимал вопрос.26 июня тема была в повестке двухсторонних консультаций с госдепом.
Американцы же продолжают упорствовать,отказываются платить справедливую компенсацию.
По-моему госдеп сделал глупость,опубличив свое унизительное предложение в марте прошлого года,не обсудив его со мной.Теперь они проявляют слабость,боясь изменить свое предложение.Это череда несуразностей тянется с 1998 года.Никто не мешал им решить вопрос сразу после аварии,нет видно нравится настраивать против себя российскую общественность,мазохистки затягивают удовольствие.Или не хватает ума и силы воли ответить за "косяк" и закрыть вопрос по-людски.
